  • What is spousal sponsorship?
    Spousal sponsorship is a process that allows a Canadian citizen or permanent resident to sponsor their spouse or common-law partner to become a permanent resident of Canada.
  • Who is eligible to sponsor a spouse?
    To be eligible to sponsor a spouse, the sponsor must: Be a Canadian citizen or permanent resident. Be at least 18 years old. Not be in prison, charged with a serious offense, or declared bankrupt. Not have been sponsored as a spouse themselves within the last five years.
  • Who can be sponsored?
    The sponsored person must be: A spouse (legally married to the sponsor). A common-law partner (living together in a conjugal relationship for at least 12 consecutive months). A conjugal partner (in a conjugal relationship for at least one year but unable to live together due to circumstances beyond their control).
  • How long does the spousal sponsorship process take?
    The processing time for spousal sponsorship can vary, but it typically takes around 12 months. However, this can be longer depending on the specific circumstances of the application and any additional information required by immigration authorities.
  • Can I work in Canada while my spousal sponsorship application is being processed?
    If you are applying from within Canada (inland sponsorship), you can apply for an open work permit along with your sponsorship application. This permit allows you to work while your application is being processed.
  • What happens if my application is refused?
    If your application is refused, you can appeal the decision to the Immigration Appeal Division (IAD) within a certain time frame. It's important to carefully review the reasons for refusal and provide any additional information or documentation required for the appeal.
  • Can I sponsor my spouse if I live outside Canada?
    Yes, you can sponsor your spouse if you are a Canadian citizen living outside Canada, but you must show that you plan to live in Canada once your spouse becomes a permanent resident. Permanent residents must reside in Canada to be eligible to sponsor.
  • Are there any income requirements for spousal sponsorship?
    Unlike other types of sponsorship, there are no minimum income requirements for spousal sponsorship. However, you must show that you can financially support your spouse and any dependent children

    You can check the status of your application online through the Immigration, Refugees and Citizenship Canada (IRCC) website using your application number and other personal details.
  • Can I sponsor my spouse if we are already in Canada?
    Yes, you can apply for inland sponsorship if both you and your spouse are already in Canada. This type of sponsorship allows your spouse to apply for an open work permit while the sponsorship application is being processed.
  • What is the difference between inland and outland spousal sponsorship?
    Inland sponsorship is when the sponsored spouse is already in Canada, allowing them to apply for an open work permit. Outland sponsorship is when the sponsored spouse is living outside Canada, and the application is processed through the visa office serving their country of residence.
